Expert witness & disputes
Expert witness valuations for disputes & litigation
In a dispute — a partnership breakdown, a shareholder action, or other litigation — a dental or healthcare practice is valued by an independent expert whose duty is to the court, in a report complying with the relevant expert-witness code of conduct. We act as single expert or party-appointed valuer.
Independence and the duty to the court
An expert witness owes a paramount duty to the court, above the interests of whoever engages them. That is only credible from a genuinely independent valuer. We don't broker practice sales and have no stake in any outcome — so our opinion is exactly that: an opinion the court can rely on.
Matters we value practices for
- Partnership & shareholder disputes — buy-outs, oppression claims, exits gone wrong.
- Litigation — where a practice's value is in issue.
- Forensic accounting matters — tracing, loss and quantum questions involving a practice.
- Family law — property settlements (see our family-law valuations).
Single expert vs party-appointed
As a single expert, we're jointly instructed by both parties and report to the court — usually the faster, lower-cost route. As a party-appointed expert, we prepare a valuation for one side, common in more contested matters. We can act in either role.
Frequently asked questions
What is a single expert witness?
One independent expert jointly instructed by both parties, whose duty is to the court rather than to either side. It's the common, cost-effective approach in many disputes.
What is the expert’s duty in a valuation?
An expert witness must give an independent, impartial opinion within their expertise, and owes their paramount duty to the court — not to the party who engaged or pays them.
What kinds of disputes do you value practices for?
Partnership and shareholder disputes, litigation involving a practice, forensic accounting matters, and family-law settlements.
Can a broker act as an expert witness?
A party that earns commission on practice sales has a conflict that undermines the independence a court expects. As independent valuers who do not broker sales, we can act without that conflict.
